A Delhi district consumer forum has ordered leading tutorial FIITJEE preparing students for entrance tests to IITs to refund part of the fee charged from an aspirant who could not attend classes due to unavoidable circumstances.
The south Delhi district consumer forum also imposed a fine of Rs 1000 on the institute for harassing the student and subjecting him to mental agony.
It passed the order on the basis of earlier rulings passed by higher judiciary barring institutes from keeping the entire fees.
The order was passed on a plea by IIT aspirant Atul Trivedi, who had taken admission in the weekend programme of IITJEE-2005 after paying Rs 46,350 as fee along with service tax of Rs 3,708.
He, however, could not attend classes due to change of his residence within just a week of getting enrolled with the institute.
Trivedi had then requested the tutorial to refund the full fee paid by him. On being refused, he approached the district forum alleging deficiency in service and unfair trade practices by FIITJEE.
The tutorial opposed Trivedi's plea that once a candidate enrols himself with the coaching centre, it should make arrangements to provide him the lessons. The institute said if it refunds the fee then it will end up suffering huge financial losses.
The forum, however, after hearing the parties said the tutorial cannot forfeit the entire fees.
"In such circumstances, the institute can forfeit the fee of the candidate but only for the first year and they cannot deprive the candidate of his fee for the second year as well," it said while partly allowing the complainant's petition.
